People For Loksatta at Pravas Bharatiya Divas presenting NRI Voting Rights petitions

"People For Loksatta" representatives Mrs. Subhashini Atluri and Ms. Padma Bhapatiraju attended the Pravasi Bharatiya Divas 2011 and presented petition for absentee voting rights for NRIs.


Sub: Absentee Voting Facility for Indians Living Abroad (NRIs)

We, the citizens of India residing abroad appreciates your commitment for providing voting rights NRI’s through the recent
The Representation of People’s Bill (Amendment)-2010. However, the Act requires that NRI’s to be physically present at the time of voting. We believe that this clause would defeat the very spirit of the Act for the following reasons:
There are around 1.5 crore Indians living outside India and it is practically impossible to have 1.5 crore Indians travel to India at the same time. Usually elections/nomination dates are announced 45 days in advance which is a very short duration to travel.
Here is an example of Indians travelling to India ~ 10 lakhs in USA (rough estimates)
  1. Students: 2 lakhs
  2. H1-B holders : Considering minimum from the last 5 years and average of 3 lakhs will be there (60,000*5=3 Lakhs)
  3. Green cards holders: will be an average of 5 lakhs
For a total of 10 Lakh People:
  1. It takes at least 100 days for the all the passengers to travel to India for voting if all the flights are fully booked.
  2. A person who came before the voting day (99th day) will have to wait until the people who came before the 98 days go back So it is not easy for him to go back until people came before him go back. Obviously one has to wait and he is losing the valuable time and money.
  3. The cost estimation for 10 lakh people travelling to India and employment loss is estimated approx at a cost of 500 crores of rupees. Please imagine for 1.5 crores of Indians.


The given NRI’s Voting Right is NEGATED without resources in place.


The available options for Absentee voting:
  1. Internet Voting
NRIs would use internet to get ballot paper and submit online. This would be the best option if technology permits.

  1. Combination of Internet and Postal Ballot
NRI’s can download the ballot paper online (from election commission website) and post the ballot to the address indicated on the ballot paper with necessary paper work.
Benefits:
  1. Very cost effective.
  2. The available technology fits well into this model.
  3. The person himself is exercising his franchise.
  4. The time frame perfectly suits to posting the ballot paper back.

UAE NRIs unhappy over voting rights with no absentee voting facility

 Many NRIs from UAE lamented on government for not providing absentee voting rights for NRIs.

Punjab education Minister supports absentee voting rights for NRIs

Punjab Education Minister and SAD Political Affairs Committee Member Sewa Singh Sekhwan Monday welcome giving voting rights to NRIs. However he demanded that the Election Commission must explore the possibility for email ballot rights to NRIs also as it may not be physically possible for each NRI to visit his native place during elections.

NRI Voting Rights team meets Andhra Pradesh MPs in bayarea

People For Loksatta (PFL) submitted a representation to Vijayawada MP Mr. Lagadapati Rajgopal and as well to Narsaraopet MP Mr. Venugopal Reddy regarding ABSENTEE VOTING FOR NRIs in person on the occassion of Andhra Pradesh state formation day event at Sunnyvale temple in Bay Area. Election Commission is likely to soon finalise the rules and regulations prescribing modalities for entry of names of NRIs in electoral rolls. In this context PFL urged the MPs to raise their voice and request for a bill amendment for ABSENTEE VOTING RIGHTS.


Mr. Venugopal Reddy, MP from Narsaraopet constituency, expressed that it is a legitimate request and publicly announced in his speech that he will look into this matter personally to see where the issue stands and take next step. Vijayawada MP Mr. Lagadapati Rajgopal though was sympathetic to the cause expressed his opinion saying that the modalities should be cautiously formulated and studied in depth so that no section of people are left out in this process. He said a careful and thoughtful analysis needs to be done while articulating the process of providing a better way to cast the vote.

Update on NRI voting Rights bill

The bill was called as "Representation of People's Act amendment 2010" and was passed as in Lok Sabha on August 31st 2010. Most MPs did not even know that it was passed and it was done in the last hours of the last  day in parliament with no further discussions after Rajyasabha. Media houses also did not come to know about this. The bill allows people to register to vote if they are not staying at home and working in foreign country. This bill leaves us now with two options.
  • Bill did not deny absentee voting rights at least explicitly. It is up to election commission on how to implement this now. We have to approach election commission on whether they implement it and how they implement it.
  • Bill does not provide absentee voting rights. All the people who are given absentee voting rights are explicitly mentioned in the "Representation of People's Act". We have to get support from some members of Parliament to introduce new bill to support absentee voting rights for NRIs.
We have diplomatic, judicial and legal options left and we should not give up until absentee voting rights are provided for all NRIs.

Prisoners to get Voting Rights in London - today's news

Many countries do not allow voting rights for prisoners. It is used to be the case in United kingdom as well.  Voting rights for sentenced prisoners were banned in 1870 forfeiture act and the same rules were  retained in the Representation of the People Act in 1983.

European court of Human Rights(ECHR) in Strasbourg ruled in 2004 that it is illegal to deny human rights including right to vote. ECHR is not related to Europian union but is common judicial agreement between 47 states of the Europe on human rights. The Government of Britain  has no easy way to deny ECHR's rule and had been working with appeals and campaigns and delayed implementation for long. Court ruled that prisoners need to get all fundamental rights other than freedom of liberty. It is generally accepted by public that prisoners do not deserve their voting rights.  However prison reform groups believe that it is part of rehabilitation and merging felons into main stream. British government finally accepted to lift the ban on prisoners today. It was costing millions of tax payers money in litigation and there is no way to substantiate the ban against all prisoners when prisoners in other countries under ECHR can vote. British Government is exploring the option of  absentee voting from prisons. British prisoners barring violent prisoners like murderers and terrorists, will soon get voting rights.

Where are we Indians in voting rights ?
India inherited voting rights laws from Britain and does not allow exercising franchise to prisoners. Now Britian is allowing voting rights for prisoners on the principle that all citizens are entitled to same rights. Will India change laws as well? Perhaps it will in next few decades.  Right now, even good citizens like NRIs are denied voting rights in Inida. NRI voting rights bill that is going to be slated to come to Parliament on Nov 9, 2010 only treats NRIs as voters and only works as instruction to election commission to not take away  names from the voter list. NRIs have to travel back to their constituencies to vote and that is impractical. There is no absentee voting. When will India provide absentee voting rights for its citizens?

Summary:  Government should work ways to provide voting rights to all citizens and not take away rights because of some fears and concerns.

exercised their franchise today through "Absentee Voting". If you are
a true citizen of India, it should pinch you that you are denied the
same facility to vote in your beloved country.

Absentee voting is not just for NRIs, if passed it will have to be
provided to your friends in India who live/work at one place and are
registered at their home constituency. NRI Voting Rights is going to

Mr. Naren Bakshi at Bayarea NRI Absentee Voting Rights Drive


Mr. Naren Bakshi, a successful entrepreneur and a community leader in silicon valley, graced the occasion as the chief guest of the day and participated in live interaction and debate. He shared his ties with Indian community and recalled how he had been living with two identities, Indian and American over the last four decades. Mr. Naren Bakshi is one of the six non government members of White-house delegation team to India in September 2010 that prepared the initial blue print for upcoming Obama's trip to India. He presented  his vision for Indo-American relations in the areas of education, e-governance and alternative energy research and conveyed that one can live as real Indian and real American at the same time. He advised the campaign team to move ahead from collecting the signatures from these few hundred people to writing articles in commercial media. He gave 'Khan Academy' as an example how technology can be used to spread awareness to larger distances with less equipment. He suggested to take the activity as the dialog instead of as fight with the Government of India. He observed that the absentee voting rights are useful for all Indians though they can be started as facility for NRIs and so the cause is in the interest of India.

  • Mr. Atanu Dey,a vivid blogger on economics and development subjects, expressed that giving absentee votingrights is not in the best interest of some politicians and warned the need for standing up to the cause.
  •  Mr. Mukund, who volunteers for Manavata, a non-profit organization, explained about his work for health related projects and questioned the lack of awareness about India among NRIs.  
  • Mrs. Anita, bay area columnist, told that she kept her Indian citizenship by choice, as that is one of the dearest things to her heart. She told that she is willing to spend 5$ postal expenses in place of 1000$ flight ticket for casting her vote as that gives her right to vote with no additional expenses to the Government.
  • Sreekanth Kocharlakota. People For Loksatta volunteer, told that he was pleasantly surprised at the awareness of Karntaka MPs of the NRI voting rights bill. One such pleasant experience was with a senior B.J.P leader Mr. Janardhana Samy. Janardhana Samy, who represents Chitradurga from Karnataka was an NRI and worked in several software companies like Cisco before moving back to India.
  • Kalyan Raman, Sanjose Business specialist, told that if Afghanistan provides absentee voting rights, why can not India provide absentee voting rights.

On oct 31st 2010,  Halloween day, several NRIs from different states gathered for discussion forum about NRI voting rights and discussed how to send message to the Government of India. There were speeches, discussion and interaction with Mr. Naen Bhakshi followed by mass signature from all the participants. Naren Bhakshi recollected how he had been living two lives over decades, Indian and American and expressed strong support for the cause. He also gave valuable suggestions to take the movement forward.

Mrs. Subhashini Press Meet

Voting from space

Some countries provide absentee ballot only for residents living abroad.  However some countries allow voters to choose either direct vote or absentee voting. Many of  you, who are living in United States, know that you can vote by mail instead of standing in the queue on the election day. This is absentee ballot in practice.

What happens, if people are not on earth but floating in space? Such people are called astronauts. Texas passed a bill in 1997 to extend voting facilities for astronauts who are not on the earth on the election day. Texas election officials used secure email as voting procedure for astronaut in 2009 elections. However Indian government is not extending absentee voting rights for NRIs who are living on earth.

Every country except India provides absentee voting rights

Several countries facilitate exercise of franchise through postal ballots (US, Spain, Italy, Portugal, Canada and UK) or at embassies and consulates (Poland, Lithuania, Ukraine, Colombia, Venezuela, Peru, France, Russia, Sweden, Philippines, Japan, Dominican Republic and Spain), or through internet voting (France). If several countries allow absentee voting rights for local residents, why can not NRIs have their say in the future of India? 10 lakh Indian citizens in USA

There are around 10 lakh Indian citizens in just United States of America.
  • 2 lakh students
  • 3 lakh temporary workers
  • 5 lakh permanent work permit holders
If 10 lakh people need to travel to India for casting vote in elections, it will take 100 days based on current airline carrier capacity.  Since it is not possible for all of them to travel on the same day and so average Indian has to take around 2 months break.  It also costs more than 100 million dollars traveling expenses that can be avoided.
